We specialise in dispute resolution.

The firm is helmed by Mr Clinton Tan whose experience is concentrated in civil litigation and arbitration. He has argued cases at all levels of the Civil Courts of Malaya and has also appeared in international arbitration disputes in Kuala Lumpur, Malaysia and Singapore.

Mr Clinton Tan obtained his LL.B (Hons) degree from the University of Bristol, U.K. in 2010 and was called to the Bar of England & Wales in 2011. He was then admitted as an Advocate and Solicitor of the High Court of Malaya in 2012, and thereafter the High Court of Sarawak in 2022.

EXPERIENCE HIGHLIGHTS

•Lead solicitor in an arbitration proceeding with a claim value of over RM 300 million, for breach of confidential information pertaining to satellite telecommunication technology.

•Lead solicitor in an application to set aside an arbitral award for the sum of approximately RM700 million that arose from an arbitration proceeding between a Fortune 500 company and an Independent Power Producer in connection with a gas supply contract.

•Lead solicitor for a Respondent company which filed a counterclaim for a sum of approximately RM 600 million in an international arbitration involving land reclamation works. The arbitral tribunal allowed both the claim and counterclaim, with the value of the Respondent’s counterclaim surpassing the claim. The arbitration award was thereafter made the subject matter of a challenge initiated in the High Court (reported in Jan De Nul (Malaysia) Sdn Bhd v Vincent Tan Chee Yioun [2016] 1 LNS 1234) and ultimately determined by the Federal Court.

•Co-counsel for a Respondent company in the Federal Court in a dispute pertaining to breach of fiduciary duties and minority oppression (reported in: Auspicious Journey Sdn Bhd v Ebony ritz Sdn Bhd & Ors [2021] 4 CLJ 721).

•Lead solicitor for Respondents in an international arbitration conducted in the Singapore International Arbitration Centre concerning performance guarantees amounting to USD50 million.

•Lead solicitor for a developer company to successfully claim against Tenaga Nasional Berhad for trespass (reported in: Tenaga Nasional Bhd v Bukit Lenang Development Sdn Bhd [2019] 1 CLJ 42).

•Lead solicitor for a telecommunication company to successfully claim a sum of approximately RM 22 million (reported in: U Television Sdn Bhd & Anor v Comintel Sdn Bhd [2017] 10 CLJ 580).

•Advised an international insurance broking company in respect of an arbitration proceeding filed with the ICC International Court of Arbitration.
